What Are Grounds for Divorce in Florida?
You are not required to show to the courts that your spouse is to blame for the divorce. Florida state allows you to file for a “no-fault divorce,” which means you are not required to provide evidence or testimony. You only need to state that marriage has deteriorated to the point where there is no chance of you and your spouse reconciling.
There are some cases where fault may be a consideration, not necessarily in divorce, but for matters involving custody, alimony, or child support. A spouse who has been unfaithful, for example, is thought to be “at-fault.” This can affect that spouse’s chances of getting an ideal alimony settlement or limit their custody arrangement.
There are minimum residency requirements to file for divorce in Florida. You must have been a resident of the state for at least six months before the judge can finalize the decree.
